Did you have contracts, and if so what did they say re reversion of rights? You usually have to write and ask for them after a certain period after a book has gone out of print. There's a second date on that old proposal - some time early 2010, I think - whereby if you haven't opted out you must register your titles, and I think this is really important if the rights have reverted to you. If you don't, then Google will not pay you any proportion of the monies accrued under their digitization scheme. If you do, they will, and some say that that's a good deal.
